Kentucky Infant's death leads to lawsuit

A hospital and two physicians in Fort Logan, Kentucky, as well as a clinic in Stanford, have been named as defendants in a medical malpractice lawsuit by the parents of an infant boy who died last month. The mother and father, who live in Crab Orchard, Kentucky, filed the lawsuit in the Lincoln County Circuit Court last month.

The infant was born on July 12 and lived for 13 days. The cause of death was never determined, according to the lawsuit. It also states that the infant became the defendant's patient when he was born "for the purpose of medical services, examinations, treatments and diagnosis."

The plaintiffs, who filed the lawsuit without representation of an attorney, allege that the physicians did not exercise an appropriate degree of skill or care that a "reasonably competent physician" would have provided under similar circumstances. Because of this, the suit alleges, the infants suffered "severe personal injury and death."

The defendants in the case have not responded, but a spokesman for the corporation that owns the hospital said they believe the actions taken to care for the infant were in his best interests.

The parents are seeking damages of an unspecified amount for medical and funeral expenses, loss of companionship, emotional distress and other claims.
