A few weeks ago, we told our readers about a case in which a man alleged that his penis was amputated during a botched circumcision. That case has been tossed out by a judge because it didn’t meet all of that state’s laws. This update might interest our Kentucky readers since it highlights the very important point of ensuring compliance with the law.
The judge who was overseeing the case ruled that the man and his wife who filed the lawsuit weren’t specific enough in their complaint. He said that there weren’t specific details in the complaint that are necessary under the state’s medical malpractice law. He remarked that the couple could file the complaint again within 30 days if they include the dates and times of the alleged surgical errors.
The attorneys for the defense are contending that the incident never happened. They claim that neither of the doctors in the lawsuit operated on the man. They contend that the circumcision, which occurred in February, was necessitated by circulatory complications of the man’s diabetes. The man is also said to have heart disease and kidney failure.
The man has had to have his legs amputated and left the courtroom in tears in his wheelchair. His attorney says that he has as many as 4,000 pages of medical records; however, he does say that he will refile the lawsuit quickly.
