Fighting For Accountability For Over-Serving

If a drunk driver hits you, that person may be at fault for your injuries and property damage. What many people do not know, however, is that the bar, restaurant or public social setting that served the alcohol can also be held liable.

At O’Brien Batten Kirtley & Coomer, PLLC, we are well-versed in these laws and how they can affect your personal injury case. One of our lawyers will take the guesswork out of your accident and will fight for your benefits and legal protections in a car accident case.

Pressing Charges After A Drunk Driver Incident

Kentucky has a clear statutory language regarding liquor liability, also known as “dram shop laws.” The law states that the business or staff serving alcohol has a reasonable responsibility not to over-serve patrons who are clearly intoxicated. In short, they should “cut off” patrons when they are too drunk.

The exception to Kentucky’s dram shop laws is during private social settings that have a host, such as at a party in someone’s home. You cannot press charges against the host for providing too much alcohol in these situations.

An Attorney Can Seek Compensation For Their Negligence

An experienced attorney can review your case and determine if dram shop laws apply to the unique situation. If there is evidence that the intoxicated individual was irresponsibly served alcohol at a bar or restaurant, your attorney can bring a lawsuit against the business.

Penalties for violating liquor liability laws can include suspension or revocation of liquor licenses and being required to pay for injuries and damages. You would likely also bring a lawsuit against the drunk driver — meaning you may recover compensation from two negligent parties.
