Dram Shop / Liquor Liability

Drunk drivers are not always alone in putting you and the rest of the public in danger of a serious car wreck. Sometimes, bars, nightclubs and restaurants knowingly overserve a patron and allow him or her to stumble to their car to drive away.

The personal injury attorneys at O’Brien Batten Kirtley & Coomer, PLLC, take on drunk drivers and the businesses that overserved them. One of our hardworking lawyers will make sure that you receive the most compensation possible for injuries you sustained in a drunk driving collision.

Dram Shop Liability In Kentucky

Kentucky is one of 42 states with a dram shop law on the books. Essentially, this law allows you to force the establishment that served alcohol to the drunk driver who hit you partly responsible for your injuries. To prove that the establishment was liable, you must show:

  • The establishment sold and served alcohol to an intoxicated customer.
  • The employee who served the alcohol knew the customer was already intoxicated by his or her appearance and/or behavior, such as slurred speech or an unsteady gait.
  • The customer’s intoxication was a foreseeable cause of the accident that injured you.

Whether the dram shop law applies to your case can be very important, because the potential damages you can receive tends to go up substantially when a bar or restaurant contributed to your injuries.
